Il rappelle\u00a0deux\u00a0points\u00a0importants\u202f:\u00a0le t\u00e9l\u00e9travail repose sur un\u00a0<b>double volontariat<\/b>\u00a0(salari\u00e9 et employeur).\u00a0<b>Ce n\u2019est donc\u00a0ni\u00a0une obligation<\/b>,\u00a0<b>ni\u00a0un droit automatique.<\/b>\u00a0<\/span><\/p>\n<p><span style=\"color: #1c1c1c\">Il s\u2019inscrit\u00a0par ailleurs\u00a0dans le cadre du Code du travail, qui d\u00e9finit le t\u00e9l\u00e9travail comme une organisation dans laquelle un travail qui aurait pu \u00eatre effectu\u00e9 dans les locaux\u00a0de l\u2019employeur\u00a0est r\u00e9alis\u00e9 hors des locaux, de fa\u00e7on volontaire,\u00a0avec\u00a0des outils num\u00e9riques\u00a0(<a style=\"color: #1c1c1c\" href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000047864720\">art. L.1222-11\u00a0du CT<\/a>).\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #1c1c1c\"><b>Conditions d\u2019acc\u00e8s au t\u00e9l\u00e9travail r\u00e9gulier (principes pos\u00e9s par l\u2019accord)\u202f:<\/b>\u00a0<\/span><\/p>\n<p><span style=\"color: #1c1c1c\">L\u2019accord pr\u00e9voit des crit\u00e8res cumulatifs\u202f:\u00a0anciennet\u00e9, autonomie, compatibilit\u00e9 avec le service et l\u2019organisation de l\u2019\u00e9quipe, pr\u00e9sence d\u2019un volume suffisant de t\u00e2ches t\u00e9l\u00e9travaillables, conditions mat\u00e9rielles\/assurance, etc.\u00a0<\/span><\/p>\n<p><span style=\"color: #1c1c1c\"><b>Rythme et cadrage\u202f:<\/b>\u00a0<\/span><\/p>\n<p><span style=\"color: #1c1c1c\">La n\u00e9gociation a permis d\u2019obtenir\u00a0<b>1 jour flexible maximum\u00a0\/\u00a0semaine<\/b>\u00a0(ou\u00a02\u00a0demi-journ\u00e9es\u00a0flexibles).\u00a0Le t\u00e9l\u00e9travail doit \u00eatre\u00a0organis\u00e9 avec\u00a0son\u00a0manager selon les\u00a0contraintes et\u00a0n\u00e9cessit\u00e9s de\u00a0service.\u00a0Des\u00a0demandes de\u00a0changements\u00a0peuvent \u00eatre\u00a0recevables dans\u00a0un d\u00e9lai\u00a0de deux mois. Il\u00a0n\u2019est\u00a0pas pr\u00e9vu de pouvoir\u00a0reporter\u00a0les jours de\u00a0t\u00e9l\u00e9travail non pris. Il\u00a0ne doit\u00a0donc\u00a0pas d\u00e9grader les droits (carri\u00e8re, formation, r\u00e9mun\u00e9ration, cong\u00e9s\/RTT, titres-restaurant, etc.) et n\u2019a pas vocation \u00e0 modifier les\u00a0horaires\u00a0habituels. Ainsi,\u00a0les r\u00e8gles de dur\u00e9e du travail et de\u00a0\u00ab\u202fjoignabilit\u00e9\u202f\u00bb\u00a0restent celles du contrat\/accords applicables.\u00a0<\/span><\/p>\n<p><span style=\"color: #1c1c1c\"><b>Indemnisation\u202f:<\/b>\u00a0<\/span><\/p>\n<p><span style=\"color: #1c1c1c\">Une allocation forfaitaire est pr\u00e9vue\u00a0en\u00a0t\u00e9l\u00e9travail r\u00e9gulier (selon\u00a0le\u00a0bar\u00e8me\u00a0de l\u2019URSSAF) et en cas de t\u00e9l\u00e9travail exceptionnel\u00a0(le t\u00e9l\u00e9travail occasionnel\u00a0n\u2019en b\u00e9n\u00e9ficie pas).\u00a0<\/span><\/p>\n<p><span style=\"color: #1c1c1c\"><b>Mat\u00e9riel\u202f:<\/b>\u00a0<\/span><\/p>\n<p><span style=\"color: #1c1c1c\">FO a demand\u00e9\u00a0et obtenu\u00a0qu\u2019une liste du mat\u00e9riel de base mis \u00e0 disposition des salari\u00e9s soit explicitement ajout\u00e9e\u00a0\u00e0 l\u2019accord.
